1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client") and Muse Pilates LLC, doing business as Muse Pilates Wellness Studio ("Studio"). By enrolling in classes, accessing the open free weight room, purchasing a membership or class pack, buying retail products, or otherwise using anyStudio service, you agree to be bound by these Terms in their entirety.
Services covered by these Terms include: Hot Yoga, Hot Mat Pilates, Barre, Reformer Pilates, and the Open Free Weight Room. If you do not agree with any portion of these Terms, you should not use our services.
2. Liability Waiver & Injury Disclaimer
PLEASE READ THIS SECTION CAREFULLY - IT AFFECTS YOUR LEGAL RIGHTS.
Each service offered at Muse Pilates Wellness Studio carries inherent risks of physical injury. By participating, you voluntarily assume all such risks, which vary by activity as described below:
2a. Hot Yoga & Hot Mat Pilates
These classes are conducted in a heated environment (typically 90-105 degrees F). Risks include but are not limited to: heat exhaustion, heat stroke, dehydration, hyperthermia, dizziness, nausea, fainting, cardiovascular stress, and aggravation of pre-existing heat-sensitive conditions. You represent that you do not have any condition contraindicated by heated exercise, including cardiovascular disease, pregnancy, multiple sclerosis, hypertension, or heat intolerance, without prior written physician clearance.
Arrive well-hydrated. Bring water and a towel to every heated class.
Inform your instructor immediately if you feel unwell during class.
Exit the heated room if you experience dizziness, nausea, or shortness of breath.
Pregnant clients must obtain written physician clearance before attending any heated class.
2b. Barre
Barre classes involve repetitive small movements at the ballet barre, light free weights, and floor work. Risks include muscle fatigue, joint strain, and falls. Grip socks are required. Clients with joint replacements, recent surgeries, or balance disorders should consult a physician before participation.
2c. Reformer Pilates
Reformer Pilates is conducted on spring-loaded equipment. Risks include pinching, entanglement, spring-related injuries, falls from the carriage, and muscle strains. Clients must attend an introductory orientation or be cleared by an instructor before using Reformer equipment. Do not adjust spring resistance without instructor guidance.
Grip socks are required.
2d. Open Free Weight Room
Use of the free weight room is at your own risk. Risks include dropped weights, improper form injuries, muscle tears, joint injuries, and equipment-related accidents. You agree to: use equipment safely and according to its intended purpose; re-rack all weights after use; not use the free weight room while impaired; and immediately report any damaged or unsafe equipment to Studio staff. Minors under 16 are not permitted in the free weight room without direct adult supervision.
2e. General Release of Liability
To the fullest extent permitted by Washington State law, you agree to release, indemnify, and hold harmless Muse Pilates LLC, its owners, instructors, employees, agents, and successors from any and all claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising out of or related to your participation in Studio activities, except in cases of gross negligence or willful misconduct.
You represent that you have disclosed all relevant medical conditions on your health intake form and will inform your instructor of any changes to your health status. We strongly recommend consulting a licensed physician before beginning any new exercise program.
3. Cancellation & Refund Policy
3a. Class Cancellations
All class reservations must be cancelled at least 12 hours before class start time to avoid penalty. This applies to hot yoga, hot mat Pilates, barre, and reformer Pilates.
Late cancellations (within 12 hours of class start) will result in full forfeiture of that class credit.
No-shows (failure to cancel and failure to attend) will result in full forfeiture of the class credit. Repeated no-shows may result in loss of booking privileges.
Free weight room access does not require a reservation and is subject to availability during posted open hours.
3b. Refunds
All class pack and membership purchases are non-refundable except as required by Washington State law.
Unused class credits from a class pack cannot be exchanged for cash or transferred to another client.
In the event of a documented medical condition preventing participation, the Studio may, at its sole discretion, issue a credit or extension upon receipt of a signed physician's note.
Retail product purchases may be returned within 14 days of purchase in original, unopened condition with a valid receipt. Opened, used, or final-sale items are not eligible for return.
4. Membership & Class Pack Terms
4a. Class Packs
Class packs are valid for the number of sessions indicated at purchase and may be used across eligible class types (hot yoga, hot mat Pilates, barre, reformer Pilates) unless otherwise specified.
Class credits expire six (6) months from the date of purchase. Expired credits will not be reinstated or refunded.
Class packs are non-transferable and may only be used by the purchasing client.
Reformer Pilates sessions may be priced separately from general class packs. Confirm pack compatibility at time of purchase.
4b. Monthly Memberships
Monthly memberships are billed on a recurring basis on the same calendar date each month via the payment method on file.
Memberships may include access to one or more service types. Please review your specific membership agreement for included services.
Free weight room access may be included in select memberships or available as an add-on. See front desk for current membership tiers.
Memberships may be cancelled with a minimum of 30 days written notice prior to the next billing date.
Cancellation requests must be submitted in writing to the Studio.
The Studio reserves the right to modify membership pricing with a minimum of 30 days advance written notice to the client.
Membership holds (pauses) may be granted for documented medical reasons or extended travel of 2+ weeks, at the Studio's discretion, for a maximum of 60 days per calendar year.
Memberships are personal and non-transferable.
5. Photo & Media Release
By participating in Studio activities - including hot yoga, hot mat Pilates, barre, reformer Pilates, and free weight room sessions - you acknowledge that Muse Pilates LLC may photograph, film, or record classes, events, or Studio activities for promotional, educational, or social media purposes.
Unless you have submitted a written opt-out request to the Studio prior to the activity, you grant Muse Pilates LLC a non-exclusive, royalty-free, worldwide license to use your likeness, image, or voice captured in such media for marketing and promotional purposes, including but not limited to social media platforms, the Studio website, email newsletters, and print materials.
No compensation will be provided for the use of your likeness.
You may revoke this consent at any time in writing; revocation applies to future captures but does not require removal of previously published content.
Photos or videos taken by clients within the Studio may not feature other clients without their explicit consent.
6. Studio Rules & Code of Conduct
To ensure a safe and welcoming environment for all clients, the following rules apply across all service areas:
Hot Yoga & Hot Mat Pilates: Arrive at least 5 minutes early. Bring a yoga mat, large towel, and water bottle. Grip socks recommended. Silence mobile devices before entering. Late entry may be denied for safety reasons.
Barre: Grip socks are required. Remove street shoes before entering the barre studio. Respect the barre equipment - do not hang or apply excess pressure to the barre.
Reformer Pilates: Grip socks are required. Do not adjust springs, straps, or headrests without instructor guidance. Wait for instructor demonstration before independent use.
Open Free Weight Room: Re-rack all weights after use. No dropping of weights. Wipe down equipment with provided sanitizing materials after each use. Closed-toe athletic shoes are required at all times. Proper athletic attire required.
All Areas: Respectful, inclusive behavior is required at all times. Harassment, discrimination, or disruptive behavior will result in immediate removal and termination of membership without refund.
7. Health Screening & Medical Clearance
All new clients are required to complete a health intake form prior to their first class or free weight room use. You agree to honestly disclose all relevant medical conditions, injuries, surgeries, medications, and physical limitations.
The Studio strongly recommends physician clearance before participation if you have: cardiovascular disease, high blood pressure, diabetes, pregnancy, recent surgery, osteoporosis, joint replacements, heat-related conditions, or any condition that may be affected by vigorous physical activity or heated environments.
The Studio reserves the right to refuse participation to any client whose participation may pose an unreasonable risk to themselves or others.
8. Payment Terms
All class, membership, and retail purchases must be paid in full at time of purchase.
The Studio accepts major credit cards and other payment methods as posted at the front desk.
Declined or failed recurring membership payments will result in a brief grace period, after which access may be suspended until payment is resolved.
The Studio is not responsible for unauthorized use of your payment information beyond our direct control
9. Intellectual Property
All class content, choreography, programming, branding, and materials created by Muse Pilates LLC instructors or staff are the proprietary intellectual property of Muse Pilates LLC. Clients may not record, reproduce, distribute, or commercially exploit any Studio content without prior written consent.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising under or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in King County, Washington.
In the event of a dispute, the parties agree to first attempt resolution in good faith through direct negotiation. If unresolved, disputes shall be subject to binding arbitration under the rules of the American Arbitration Association
before any litigation is initiated, except that either party may seek injunctive relief in court where necessary to prevent irreparable harm.
11. Modifications to Terms
Muse Pilates LLC reserves the right to modify these Terms at any time. Updated Terms will be posted in the Studio and on any applicable digital platforms with a revised effective date. Continued use of Studio services following any modification constitutes your acceptance of the revised Terms.
